Since we do not collect age information in most scenarios, we would not be able to identify whether the personal data processed relate to minors. If you are a minor under the age of 18, you shall obtain the written consent of your parent(s) or legal guardian in advance prior to your use of any Services provided by Cainiao. If you are a parent or legal guardian of a minor and believe that the child under your guardianship has used the Services and provided personal information to us through the Services, please contact us using the contact details under the “How to contact us” heading below and we will work to delete that Services account and any such personal information.

2.             Collection of personal information

The personal information that we may collect about you falls into the following categories:

2.1.         Information that you provide voluntarily

Certain parts of our Services may ask you to provide personal information voluntarily: for example, we may ask you to provide your contact details in order to register an account with us. The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information.

a.       Registration as a user of our Services

You need to register a Cainiao account to use the Services. To create your Cainiao account, you need to provide us and/or our service provider with mobile phone number. Cainiao service provider may create Cainiao account for you with mobile phone number on behalf of you. You can set up a password for your own Cainiao account or use the SMS verification code to log in to your Cainiao account. Upon processing your registration, a Cainiao ID will be automatically created for you.

b.       Managing your personal profile

You can go to the account setting to provide more personal information about yourself. Please note that this step is optional for you to use the Services.

c.       Using the Services

To provide you the Services, we need to collect and use the following information from you. If you use Cainiao’s pickup reminder service, we will associate the package fulfillment information with the mobile phone number you used when registering and send you pickup code when your package is placed at a courier service station;

d.       Push notification of service message

You can set your notification preference in “Me – Settings” page and choose to receive the service information about your orders through SMS, WhatsApp (which may not be available to the jurisdiction where you are located) or other means we provide. If you select “SMS Notification”, you need to submit your mobile phone number for receiving SMS (while we will pre-fill the mobile phone number provided for registration by default); if you choose “WhatsApp Notification”, you need to follow the operation instructions to complete the mutual subscription between your WhatsApp account and Cainiao’s official account, as well as the settings of message receiving. We will obtain your WhatsApp ID and record the communication between you and Cainiao.

Where you have provided your consent to us, we may send you marketing messages through the way you choose to receive the order service information. You can turn on and off the marketing message notification in the notification settings at any time.

Without prejudice to the above two paragraphs, the specific means through which you can receive the order service information as well as marketing messages (if you have provided your consent) depend on the country or region you are located in.

e.       Reporting problems or otherwise communicating with us

You can report problems with a delivery order by providing details about the problem in the App. You can also contact us via the contact details under the “How to contact us” heading below. We will collect and record the information provided by you while communicating with us.

f.        Ensure your normal use of the App

When you use the App, in order to ensure your normal use of our Services, we will automatically collect and record the device location and mobile device-related information, including but not limited to the information listed in Section 2.2 of this Privacy Policy. This type of information is basic information that must be collected to provide services. Your use of the App means that you authorize us to collect your information. If you refuse to provide this type of information, you will not be able to use our Services.

2.2.         Information that we collect automatically

When you use our Services, we and our service providers operating on our behalf, may collect certain information automatically from your device including but not limited to, the IP address, your login time and attempts, operation system type and version number, manufacturer and model of your mobile device, device identifier, general location information such as city and state, better detect and prevent any potential abuse, harmful activity, fraud, spam, and illegal activity on Cainiao, as well as carry out data analysis and test to ensure the stability and security of the Services.

We may collect such information directly from your device or through the use of third-party software development kits (“SDKs”). We will fulfill our duty of due diligence and conduct strict security monitoring on the SDKs used by our partners to ensure data security. The third-party SDKs we integrate are primarily to serve your needs as well as those of other users. Therefore, to meet new service demands and changes in business functions, we may adjust the third-party SDKs we integrate. We will promptly disclose the latest information regarding the integration of third-party SDKs in this notice. The current list of third-party SDKs integrated into the CAINIAO App is as follows:

2.3.         Information that we obtain from third party sources

From time to time, we may receive personal information about you from third-party sources, including feed-backs from customers who use our delivery services and certain SDK providers, e.g. location SDK provider Google Map who provide us your location data.

3.             Processing of personal information

Notwithstanding the specific purposes set forth above, Cainiao will use the personal information we collect from you for the following purposes:

•        to facilitate the set-up, operation, maintenance and administration of your account with us, and provide account-related services and support;

•        to administer and facilitate the delivery of your orders;

•        to respond to your questions and assist you with issues you may have while using the Services;

•        for project purposes such as the implementation of systems maintenance, facilitating data migration and testing and data archival and warehousing;

•        to conduct market or satisfaction survey, trend analysis and data analysis;

•        to keep our Services secure, for example, to assess account security and transaction risks, detect and prevent fraud and other security incidents;

•        to send you marketing information, if you have opted-in where required by law, or otherwise get in touch with you, e.g., offering or promoting our or a third party’s products or services to you by text message, email or other means;

•        to prevent, detect or investigate disputes, crime, fraud, security breaches or potentially illegal activities, and for internal/external audit or compliance purpose;

•        to seek professional advice, including legal advice, or enforce your obligations including, without limitation, to defend the rights of us, our partners, customers, contractors or third-party service providers;

•        to address, investigate or resolve any complaints, claims or disputes;

•        for legal, safety and security, accounting, administrative, and management purposes, including, without limitation, to create management or strategy reports or analysis thereof;

•        to comply with regulatory, compliance, or legal obligations and/or requirements;

•        as permitted or required by applicable law, to assist the investigation, law enforcement and other government authorities related matters; or

•        for other purposes related to the aforementioned with your consent or as set out in the specific terms and conditions that govern our relationship with you.

In general, we will use the personal information we collect from you only for the purposes described in this Privacy Policy or for purposes that we explain to you at the time we collect your personal information. Where required under applicable law, we will only use your personal information with your consent; as necessary to provide you with products and services; to comply with a legal obligation; or when there is a legitimate and overriding interest that necessitates the use.

4.             Disclosure or sharing of personal information

Protection of your personal information and privacy is imperative to us. For your personal information, we will only use it for the purpose and within the scope under this Privacy Policy, or collect and use it in accordance with the requirements of laws and regulations, and strictly keep them confidential. We may disclose your personal information to the following categories of recipients:

i.           Cainiao group companies: we may also disclose your information with other members, subsidiaries, or affiliates of our corporate group, to provide our Services including improving and optimizing our Services, preventing illegal use and supporting users.

ii.          any other business partners who otherwise process personal information for purposes that are described in this Privacy Policy or notified to you when we collect your personal information and get your consent hereafter.

iii.        any competent law enforcement body, regulatory, government agency, court or other third parties where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, (iii) to protect your vital interests or those of any other person,; (iv) to detect, prevent or otherwise address security, fraud or technical issues, (v) to protect the rights, property or safety of us, our users, a third party or the public as required or permitted by law (including exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction), or (vi) to enforce our Terms of Use and other agreements, policies, and standards, including investigation of any potential violation thereof.

We use appropriate technical and organizational measures to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. For example, we use SSL to encrypt and protect data; we have established an access control mechanism to ensure that only authorized personnel can access the personal information of our users; we hold security and privacy protection training courses from time to time to increase employees’ awareness of the importance of protecting personal information. In the event of a personal information security incident, we will promptly inform you in accordance with the requirements of applicable laws and regulations in a manner that is appropriate and sufficient to bring this to your attention, and we will immediately activate the emergency plan to minimize the loss.

The Internet is not absolutely safe, it is advised that you should take proper care of your own personal information, especially your account name and password, and only disclose it to others when necessary. If you find that your personal information, especially your account and password, has been divulged, please contact Cainiao immediately, so that Cainiao can take appropriate measures based on your request.

You may obtain, have access to or may otherwise process personal information about other individuals (e.g. senders and recipients of delivery orders) while using the Services. You hereby undertake to protect the personal information strictly complying with applicable laws and regulations.

6.             International data transfers

The Services Cainiao provided is in Israel and the information we collect is governed by the Protection of Privacy Law, 5741-1981 and the regulations promulgated thereunder (the 'PPL') and the guidelines of the Israel Privacy Authority. Your personal information will be stored and retained in the servers in Singapore and China that we maintain to bring you our Services continuously. To provide you the Services, security maintenance and other purposes specified in this Privacy Policy, we may transfer your personal information to our affiliates, service providers or business partners who may be located in countries or regions other than where you are located, including in countries that are not considered to offer an adequate level of protection under your local laws. If required by applicable laws and regulations, we will take necessary legal, physical, technical and administrative measures to protect your personal information, when we transfer your personal information to recipients in other countries. BY SUBMITTING YOUR PERSONAL INFORMATION TO CAINIAO, YOU ACKNOWLEDGE AND CONSENT TO SUCH TRANSFER, STORING AND/OR PROCESSING OF PERSONAL INFORMATION.

7.             Retention of personal information

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

When we have no ongoing legitimate business need to process your personal information or you exercise rights to erase your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
